Terms of Use

Terms of Use

Effective Date: October 1, 2026

Operated by: Cul7ure Corporation, a Delaware corporation, United States. Business address: [address].

About These Terms

These Terms of Use (the “User Agreement”) govern Kul7ure websites and member features provided by Cul7ure Corporation (“Cul7ure Corp,” “we,” “us,” or “our”). Kul7ure is the platform name; Cul7ure Corp is your contracting party.

By selecting Continue with Google and completing sign-up, you agree to this User Agreement and the Kul7ure Rules. The Privacy Policy explains our data practices and is presented before registration. Acknowledging it is not blanket consent to optional tracking, marketing, or all processing of personal data. Where separate consent is required, we request it separately. Visitors are bound only to the extent they receive adequate notice and applicable law recognizes their acceptance.

If you do not agree to these Terms, please do not use the service.

You must be at least 14 years old and meet any higher local minimum age or other mandatory eligibility requirements. If you are below the age of legal majority, a parent or guardian must review and agree to these Terms where required. Any separate parental authorization required for processing personal data must also be obtained. Do not misrepresent your age. We may restrict accounts that do not meet these requirements.

Accounts and Membership

Some content may be available without an account. Member features require registration and any necessary verification or profile information.

Provide accurate information, keep your account secure, and contact hello@kul7ure.com if you suspect unauthorized access. You are responsible for activity on your account. Do not sell, transfer, or share access to your account without our permission.

Invited Member access is granted through an invitation and is limited to the permissions described when access is offered. It does not automatically grant moderation rights, official status, or affiliation with an artist or organization.

Invited access may change or end in accordance with these Terms. All Invited Members must follow the Kul7ure Rules.

Your Content and Our Service

You retain ownership of content you create and must have the rights and permissions needed to share it.

When you submit content, you grant us a nonexclusive, worldwide, royalty-free license to host, store, display, reproduce, and technically adapt that content as necessary to operate and provide Kul7ure. This includes use by service providers acting on our behalf for those purposes.

This license does not authorize unrelated advertising use of your identity or content without separate permission.

The license ends when your content is deleted from our systems, except for legally required retention and limited backup copies until they are removed under our retention schedule.

Copies independently made by others may remain outside our control.

Kul7ure branding and service materials belong to us or their respective rights holders. These Terms do not transfer ownership of those materials to you.

Copyright and Rights Complaints

We respect the rights of artists, creators, and rights holders.

If you believe content on Kul7ure infringes your copyright or other rights, contact hello@kul7ure.com with a description of the original work, the relevant Kul7ure content link, your contact information, and a statement that you are the rights holder or authorized to act on their behalf.

Our designated copyright agent’s details are [agent name, postal address, telephone number, and email].

We may remove content in response to valid notices and may close accounts belonging to repeat infringers.

If your content was removed and you believe the decision was made in error, you may contact us to request a review.

A copyright notice should identify the work and the specific material and its location, provide the claimant’s contact details and signature, and include the good-faith and accuracy/authority statements required by 17 U.S.C. § 512(c)(3). A counter-notice must satisfy § 512(g)(3), including identification of the removed material and its former location, a statement under penalty of perjury about mistake or misidentification, contact details, signature, and the required consent to jurisdiction and service. We forward qualifying counter-notices to the claimant and, where the DMCA procedure applies, ordinarily restore material 10–14 business days after receiving a qualifying counter-notice unless notified of a qualifying court action. A counter-notice is a legal submission and may disclose your identity to the claimant. Knowingly false notices can create liability. Ordinary moderation appeals and trademark complaints are separate from this process.

Acceptable Use and Third-Party Material

Follow applicable laws and the Kul7ure Rules.

Do not interfere with the service, bypass access controls, or collect personal information without authorization, including through scraping.

External links and third-party content remain subject to their respective terms.

Member opinions are their own. Topic listings and activity indicators do not establish endorsement, accuracy, or an official relationship.

Moderation and Account Closure

We may remove content, limit visibility, restrict features, or suspend or close accounts for violations of this User Agreement, the Kul7ure Rules, applicable law, or threats to safety or security. We consider severity, context, recurrence, and available evidence. We may act without prior warning where urgent action is justified. This does not remove any notice, reasons, review, or other procedural rights required by law.

Serious violations may result in immediate action.

To request a review, contact hello@kul7ure.com.

Ending Your Account

You may stop using Kul7ure at any time and request account deletion through Settings > Account > Delete Account.

We may suspend or close your account as described in these Terms.

Content removal, data retention, and any exceptions are explained in our Privacy Policy.

Sections that by their nature should continue, including content ownership, disclaimers, limitation of liability, and indemnity, remain in effect after your account ends.

Disclaimers

Kul7ure facilitates discovery and discussion. Members are responsible for their own submissions and conduct. We do not endorse or guarantee member claims, rumors, reviews, translations, AI-generated summaries, external websites, or third-party products. Verify important information with original sources. Platform content is not professional medical, legal, financial, or safety advice. Our moderation activity does not mean that every submission has been reviewed or approved.

Content posted by members reflects their own views, not ours.

To the extent permitted by applicable law, Kul7ure is provided "as is" and "as available," without warranties of any kind, express or implied.

Limitation of Liability

For users in the United States and elsewhere outside the EEA, and only to the fullest extent applicable law allows, Cul7ure Corp and its officers, employees, and service providers are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits, business opportunities, or data, arising from use of or inability to use Kul7ure. These limits cover relevant contract and tort claims where lawful. The EEA consumer protections below take priority for eligible consumers.

For claims to which a liability cap may lawfully apply, Cul7ure Corp’s aggregate liability relating to the service is limited to the greater of (a) US$100 or (b) the amounts you paid Cul7ure Corp for the service in the twelve (12) months before the event giving rise to the claim.

Nothing in these Terms excludes or limits liability for fraud, deliberate misconduct, gross negligence where it cannot lawfully be limited, death or personal injury caused by our negligence, infringement of non-waivable privacy rights, or any other liability or remedy that applicable law does not permit us to exclude or limit. Registration does not waive mandatory consumer or data-protection rights.

Indemnity

For users outside the EEA, to the extent permitted by applicable law, you agree to indemnify Cul7ure Corp against reasonable third-party claims and related costs caused by your unlawful submissions or material breach of these Terms. This does not cover loss caused by our own unlawful conduct. We will give reasonable notice and allow appropriate participation in the defense. No settlement may impose an admission or nonmonetary obligation on you without your consent. EEA consumers are not subject to a blanket obligation to indemnify us; any responsibility is determined under applicable law.

Changes and Contact

We may update these Terms and policies for stated operational, security, legal, or product reasons. We publish the revised version and effective date.

Minor clarifications and changes that do not materially reduce your rights may take effect when posted without a separate individual notice, unless the law requires otherwise. For material changes affecting users’ rights or obligations, we will provide advance notice by email or a prominent in-service notice, normally at least 30 days before effectiveness. A shorter period may be used where legally permitted and reasonably necessary for urgent legal or security reasons, with an explanation. Changes do not retroactively remove accrued rights. If you disagree, you may stop using Kul7ure and close your account before the change takes effect. Continued use constitutes acceptance only where legally effective; we seek renewed affirmative acceptance when required. Privacy changes requiring consent follow the Privacy Policy and cannot be authorized merely by changing these Terms.

For questions, contact hello@kul7ure.com.

General

United States: applicable U.S. federal law and the laws of the State of California govern these Terms, without regard to conflict-of-laws rules and subject to any mandatory protections that apply to you. To the extent this venue choice is lawful, disputes will be resolved in the state or federal courts located in Los Angeles County, California. These Terms do not require mandatory arbitration or waive your right to participate in a class action.

EEA Consumer Terms

If you habitually reside in the European Economic Area (the EU plus Iceland, Liechtenstein, and Norway), these additional protections apply where required by law. Cul7ure Corp remains your contracting party; we do not represent that an EU subsidiary operates Kul7ure. You retain mandatory protections of your country of habitual residence and may bring proceedings in courts available to you under applicable consumer law. Our choice of U.S. law or courts does not remove those rights.

We will exercise reasonable care and skill in providing the service. The general “as is” wording, damage exclusions, liability cap, and indemnity do not displace mandatory consumer remedies. We do not exclude responsibility for foreseeable loss caused by our breach where the law requires compensation. Material service changes must have a valid reason and follow legally required notice, information, cancellation, or refund rules. Any future paid services will have separate price, cancellation, and withdrawal information before purchase.

The United Kingdom and Switzerland are outside the EEA. Their own mandatory consumer and privacy rules apply when relevant; this EEA section does not represent that EU legislation automatically applies there. Users in all other countries retain mandatory rights available under their local law.

Other General Terms

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.

This User Agreement and the Kul7ure Rules govern use of Kul7ure. The Privacy Policy separately explains personal-data processing. Region-specific mandatory protections prevail over inconsistent general terms.

We may transfer these Terms as part of a business transfer.

Our failure to enforce a provision does not waive our right to enforce it later.
